ARTISTHEAD, a division of ARTISTHEAD MUSIC, LLC., values your privacy, accordingly we have set out this policy that states clearly how we use and store personal data.

1.    PRIVACY
We take care to protect the privacy of our Members and Customers. This policy explains how we process info about all website visitors and those registered with us on The ARTISTHEAD Website, here unto also referred to as the Service.

2.    WEBSITE DATA COLLECTION
Personal data is collated and stored primarily during the registration process, but is also monitored when there is activity on your account and when you use the website. As with many other websites, we may use software known as 'cookies' to store info relating to your preferences to enable us to improve our service to you.

3.    YOUR PERSONAL DATA
Personal data submitted by you to this website will be used for the following purposes only. We will only collect and retain personal data to the extent that it is strictly necessary for our purposes. These purposes are; to assist us in setting up and managing your account; to build up an accurate customer profile of you, in order to make available to you promotional or relevant info from us. ARTISTHEAD may also collect personal data from you if you choose to participate in ARTISTHEAD Service activities like sweepstakes, contests, and surveys, because you want us to furnish you with products, services, newsletters, or info, or in connection with content or suggestions you submit to us for review.

4.    DISCLOSURE OF YOUR PERSONAL DATA
Personal data that we collect about you when you visit this site will be disclosed only to the following types of persons:

      a). Any company or other entity to whom we may sell all or part of our business;

      c). Our professional advisers or other appropriate third parties, if your use of our service or this website is in breach of these terms and conditions.

5.    DATA ACCESS & CORRECTIONS
Upon your written request, we will disclose to you your personal data held by us and we shall correct or delete inaccurate details. Changes to your Account info may also be made by accessing the "Edit Profile" section of your Member page. We regularly delete data, which is no longer required. If you ask ARTISTHEAD to stop using your personal data, ARTISTHEAD will honor that request while retaining any record of your personal data that is necessary to comply with applicable federal, state or local law.       6.   CHILDREN UNDER THE AGE OF 13
 ARTISTHEAD does not knowingly collect or solicit personal data from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please do not attempt to register for the Service or send any info about yourself to us, including your name, address, telephone number, or email address. No one under age 13 may provide any personal data to or on ARTISTHEAD. In the event that we learn that we have collected personal data from a child under age 13 without verification of parental consent, we will delete that info as quickly as possible.      7.   CHILDREN BETWEEN THE AGES OF 13 AND 18
 We recommend that minors over the age of 13 ask their parents for permission before sending any info about themselves to anyone over the Internet.

       8.  LOCATING OTHER ARTISTHEAD MEMBERS
In order to locate other ARTISTHEAD Members that you may, or may not already know in the physical world, ARTISTHEAD allows Users to search for Members using Registration personal data (i.e., full name or email address). ARTISTHEAD also allows Users to browse for certain Member Info in order to help connect with Members (i.e., Artist or Band names, schools and/or companies where Users may have attended or worked). ARTISTHEAD may also enable Members to publicly display some Registration personal data as an element of their Profile Info if they choose to do so via a profile setting under “Edit Profile.” Search engines may index the portion of a Member’s profile (including the Profile Info it contains) that is publicly displayed.

        9.  THIRD PARTY ADVERTISEMENTS
Third party advertisements displayed on the ARTISHTHEAD Service may also contain cookies set by Internet advertising companies or advertisers (known as “third party
cookies”). ARTISHTHEAD does not control these third party cookies and Users of the
ARTISHTHEAD Service should check the privacy policy of the Internet advertising
company or advertiser to see whether and how it uses cookies. See the “Notice”
section below for more info on customized advertising on ARTISHTHEAD.

A pixel tag is a tiny image inserted in a webpage and used to record the number and types of views for that page. ARTISHTHEAD may allow third party pixel tags to be present on ARTISHTHEAD Services for purposes of advertising, providing services or data and statistics collection. You can program your computer to warn you each time a cookie is being sent, block third party cookies or block all cookies. However, by blocking all cookies you may not have access to certain features on the ARTISHTHEAD Services.

       10.  THIRD PARTY LINKS
ARTISTHEAD may be linked to Internet sites operated by other companies and may also carry advertisements from other companies. ARTISTHEAD is not responsible for the privacy practices of websites or other services operated by third parties that are linked to or integrated with the ARTISTHEAD Service or for the privacy practices of third party Internet advertising companies. Once you leave ARTISTHEAD Services via such a link, access a third party application (such as widgets) or click on an advertisement, you should check the applicable privacy policy of the third party or advertiser site to determine, among other things, how they will handle any personal data they collect from you. Users who visit ARTISTHEAD Affiliated Company sites should still refer to their separate privacy policies and practices, which may differ in some or all respects from ARTISTHEAD’s privacy policy.

    11. OTHER USES
ARTISTHEAD employees, agents and contractors must have a business reason to obtain access to your personal data. ARTISTHEAD may share your personal data with those who help us manage or provide ARTISTHEAD info activities (for example, message board administration, order fulfillment, statistical analyses, data processing), or with outside contractors, agents or sponsors who help us with the administration, judging and prize fulfillment aspects of contests, promotions and sweepstakes. These outside contractors, agents or sponsors may temporarily store some info on their servers, but they may only use your personal data to provide ARTISTHEAD with a specific service and not for any other purpose. ARTISTHEAD may also provide your personal data to a third party in those instances where you have chosen to receive certain info and have been notified that the fulfillment of such a request requires the sharing of your personal data. ARTISTHEAD also may share your personal data with Affiliated Companies if it has a business reason to do so.

There may be instances when ARTISTHEAD may access or disclose personal data, Profile Information or non-personal data without providing you a choice in order to: (i) protect or defend the legal rights or property of ARTISTHEAD, our Affiliated Companies or their employees, agents and contractors (including enforcement of our agreements); (ii) protect the safety and security of Users of the ARTISTHEAD Service or members of the public including acting in urgent circumstances; (iii) protect against fraud or for risk management purposes; or (iv) comply with the law or legal process. In addition, if ARTISTHEAD sells all or part of its business or makes a sale or transfer of all or a material part of its assets or is otherwise involved in a merger or transfer of all or a material part of its business, ARTISTHEAD may transfer your personal data to the party or parties involved in the transaction as part of that transaction.

12.  TRANS-BORDER DATA TRANSFERS
No transfers of your personal data are currently made outside of the United States of America. However, we reserve the right to relocate our web servers to a secure location outside the U.S.A. in the future. If we do this, we will enter into agreements requiring the guardians of your personal data to adhere to standards of data protection substantially similar to those prevailing in the United States of America. However, the Internet is made up of a large variety of international connections and if you are visiting this website the various communications may well result in the temporary transfer of info outside the United States of America other than pursuant to contractual arrangements made by us. When a Member who is located in the European Union chooses to post Profile info that will be publicly disclosed, that Member is responsible for ensuring that such info conforms to all local data protection laws. ARTISTHEAD is not responsible under the EU local data protection laws for Member-posted info.

     13.   SECURITY
 ARTISTHEAD takes appropriate precautions to protect our users' info. Your account info is located on a secured server behind a firewall. When you enter sensitive info (such as credit card number or your password), we encrypt that info using secure socket layer technology (SSL). Because email and instant messaging are not recognized as secure communications, we request that you not send private info to us by email or instant messaging services. 14.  GOVERNING LAW AND DISPUTES
This policy and consent forms part of our website terms of use and as such it shall be governed by and construed in accordance with the laws of The State of Nevada, United States of America. You irrevocably agree that the courts of The State of Nevada, United States of America, shall have exclusive jurisdiction to resolve any dispute or claim of whatever nature arising out of or relating to this policy and consent or otherwise to the use of your personal data, and that the laws of The State of Nevada, United States of America, shall govern such dispute or claim. However, we retain the right to bring legal proceedings in any jurisdiction where we believe that infringement of our intellectual property rights or breach of those terms is taking place or originating. You are responsible for compliance with any applicable laws and regulations of the jurisdiction from which you are accessing this website. We operate this website from the United States of America and make no representation or warranty that the info contained herein is appropriate or available for use in other locations outside the United States of America.

Any controversy or claim arising out of or relating to these Terms or our sites will be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. Your use of ARTISTHEAD, and any disputes arising from it, is subject to this Privacy
Policy as well as our Terms of Use and all of its dispute resolution provisions including arbitration, limitation on damages and choice of law. We reserve the right to change our Privacy Policy and our Terms of Use at any time. Non-material changes and clarifications will take effect immediately, and material changes will take effect within 30 days of their posting on this site. If we make changes, we will post them and will indicate at the top of this page the policy's new effective date. If we make material changes to this policy, we will notify you here, by email, or through notice on our home page.
